I usually have my Subway sandwiches cold, so when they say, Do you want it toasted? I tell them, No, no toasting. I used to have it toasted when they first started toasting.
Then I noticed that some sandwiches cost more than others, when I actually ordered the same sandwich.
What I found later, after looking it up, is that a hot sandwich is charged tax and a cold sandwich to go, I mean if you don't eat that cold sandwich there on there premises, there is no tax.
I will have to remind the reader of this blog, that I live in the Central California area, in California there is no tax on a cold sandwich that you don't eat on the premises. So I always say, Just the sandwiches to go.
But there was this one time, that some newer workers were there and they charged me the tax, and I said that I'm not supposed to be charged the tax, since they didn't toast my sandwiches. And the guy said, You have to pay the tax.
Then there was a guy in line after me, saying they always charge tax, you have to pay the tax. I did notice that he wanted his sandwich toasted.
I said to the guy over the counter, there is not suppose to be a tax, as I didn't have my sandwich toasted. So the guy over the counter says, You have to pay the tax. And the guy inline after me said, This is California, they tax everything. And in most cases that is true.
But I said, They are not supposed to charge tax on a cold sandwich to go.
Then the guy looked at the receipt and he noticed something and ran it through the cash register again and this time there was another total, with no tax.
So they gave me my change with no tax, and I said, Thank you. And I left them a dollar tip in their little tip bowl and went my way.
Then I got home and looked up Subway, cold sandwiches vs hot sandwiches and which are taxed and which are not taxed. And printed out part of articles that mentioned the law concerning this, since I didn't want to go through that again, and I have writing with the laws and cold sandwiches, that are take out, are not supposed to be taxed. So I printed out those parts of articles and put them in my fanny pack, that I wear now days.
So times it helps to have some proof.
