Worker Wrongly Fired for 'Michael Jackson' Noises-Judge

A Manchester employment tribunal has ruled that warehouse worker Lucasz Zawadzki was unfairly dismissed after being accused of making “Michael Jackson-style” noises at work, including the high-pitched “hee-hee” sound. Zawadzki admitted to making what he called “embarrassing and juvenile” grunting and moaning noises with a colleague but denied any racist intent or that he was targeting anyone.

The tribunal found there was no proof that his behaviour caused distress, and Zawadzki had never been given the company’s bullying and harassment policy, nor warned that his actions could lead to dismissal. Despite the Co-op claiming he had committed gross misconduct, the tribunal decided the firing was unfair and awarded him £10,611 ($14,301), though the amount was reduced by half because his conduct could still have been irritating or embarrassing to coworkers .

The ruling has drawn attention because it shows employers can’t simply act on unusual complaints without evidence or following proper procedures. Even minor or awkward behaviour in the workplace can’t justify dismissal if staff haven’t been properly informed or warned.
