Fraud and Misappropriation in the Venezuelan Legislation. The world of law has always called my attention; hence the love I have at all times to watch movies, series and all kinds of documentaries that have to do with this subject; even more, if they are related to the criminal field. In fact; I have a brother who is a lawyer and his specialty is criminal law, he already has 25 years of experience in this profession; in addition, for 4 consecutive years he was Prosecutor of the Public Ministry in the city of Puerto Ordaz, Bolivar State, Venezuela. In that sense; every time I talk to him, we can talk about the cases he is handling and there we spend a lot of time talking; and in case you did not know, I had the opportunity to study law for a while, but for reasons that are not relevant, I could not finish it; hence I have some knowledge about it. Now; being at home, I was struck by a very interesting book that I had the opportunity to read and talking with my brother, I could clarify many doubts that arose in this regard; coincidentally my brother is handling a case on the subject in question and this led me to inquire much more about this book, until I finished reading it in an incredible way. At home we have several books on criminal law and little by little I will be keeping an eye on them to bring them to you as much as possible. In this case we are going to enjoy the book Estafa y Apropiación Indebida en la Legislación Venezolana; this book may be unproductive for some; however, for those who are immersed in this field; whether they are lawyers, judges, officials, law students or simply interested; I am sure it will be very helpful. Alberto Arteaga Sanchez, author of this work; is a successful Venezuelan jurist with an outstanding trajectory and writer of great works related to the field of law. With this book; those interested in the subject, will be able to identify to a great extent the difference between fraud and misappropriation; two subjects that we are commonly used to confuse; however, in the criminal field they are crimes that are punished in our country. In this sense, as we go through the book, we find in detail the theoretical terms on the topics covered and the evolution of these crimes, which are committed by people from different social strata. In a few words; this is a work that we all should read to be clear about the different crimes that exist and also, to be forewarned to these people who do not have any consideration for the victims. Among them; deception, error, prejudicial patrimonial disposition and profit motive are identified. I was also able to clarify these terms with my brother, who told me first hand the meaning of each one of them; he also agrees with the author when expressing that it is not only necessary to know these concepts, but it is also necessary to understand that the application of each one of them can change the aspect of the crime. Consequently, we know that in the judicial field, the omission or faulty description of a term can be the cause of certain confusions; in such sense, the objective of this text is to be clear on what frauds and misappropriations are. Next, I indicate a little about both terms and this does not mean that I am issuing spoilers; but, it is always good to have a precise knowledge about the topics discussed. In this case; the author tells us that the swindle is based on a deception that occurs at the beginning, in order to receive a good. Now; as far as misappropriation is concerned, it starts with the legitimate possession of a good; however, this possession becomes illegal. The latter seems to be a mess; however, according to the examples described in the book; in a particular way I can create an example of my own and this is something in which any of us can incur; therefore, we must have knowledge about it, because there are also several types of misappropriation. For example; I receive money with the commitment to return it in x time and when the term is fulfilled I do not return it; in addition, I do with that money what I want; there I am incurring in the above mentioned crime, if you have done this; take care because you know what awaits you.    What strikes me about this book; is that although the subject could be complex for those who are not immersed in this world; the author is extremely didactic, methodical and uses a technical language that is easy to understand. If you know about the subject, you are a student, or you are simply curious to learn new things; I am sure you will understand it. In addition; the text is very well structured, which makes it easy to locate the points of interest; for example, the author also explains that it is not enough to breach a contract; but, it is of utmost importance to demonstrate that there has been bad faith and intent to commit fraud since the beginning of the action. One thing we must understand is that there are different modalities of fraud and misappropriation. Another point highlighted by the author is that criminality has advanced in such a way that it is imperative to update our Venezuelan laws; this is said because one aspect to highlight are the crimes of a technological nature and this surprises me, since the book has been on the market for some time and the author was already looking into the future of the criminal world. In short; this is an extremely interesting text for those who are immersed and interested in criminal law. A very explicit work; where you can find theories, practices and a lot of logical analysis; which guarantees a detailed and precise learning about the topics covered. El mundo del derecho siempre me ha llamado la atención; de allí el amor que tengo en todo momento de ver películas, series y todo tipo de documentales que tienen que ver con este tema; más aun, si se relacionan con el ambito penal. De hecho; tengo un hermano que es abogado y su especialidad es el derecho penal, ya tiene 25 años de experiencia en esta profesión; además, durante 4 años consecutivos fue Fiscal del Ministerio Público en la ciudad de Puerto Ordaz estado Bolivar Venezuela. En tal sentido; cada vez que hablo con él, nos podemos a conversar sobre los casos que lleva y allí tardamos un montón de tiempo platicando; y por si no lo sabían, tuve la oportunidad de estudiar un tiempo la carrera de derecho, pero por razones que no vienen al caso no pude culminarla; de allí que tengo algún conocimiento al respecto. Ahora; estando en su casa, me llamó la atención un libro muy interesante que tuve la oportunidad de leer y conversando con mi hermano, pude aclarar muchas dudas que me surgieron al respecto; casualmente mi hermano está llevando un caso sobre el tema en cuestión y esto me llevó a indagar mucho mas sobre este libro, hasta terminarlo de leerlo de una manera increíble. En casa tenemos varios libros sobre derecho penal y poco a poco les estaré echando un ojo para llevárselos a ustedes en la medida de lo posible. En este caso vamos a disfrutar del libro Estafa y Apropiación Indebida en la Legislación Venezolana; este libro podrá resultar improductivo para algunos; sin embargo, para aquellos que están inmersos en este campo; ya sean abogados, jueces, oficiales, estudiantes de derecho o por simple interés; estoy seguro que les servirá de mucha ayuda. Alberto Arteaga Sánchez, autor de esta obra; es un exitoso jurista venezolano con destacada trayectoria y escritor de grandes obras que están relacionadas al campo del derecho. Con este libro; los interesados en el tema, podrán identificar en gran medida la diferencia que existe entre la estafa y la apropiación indebida; dos temas que nosotros comúnmente estamos acostumbrados a confundir; sin embargo, en el ámbito penal son delitos que son castigados en nuestro pais. En tal sentido; a media que vamos indagando por las líneas del libro, encontramos de forma detallada los términos teóricos sobre los temas tratados y la evolución que han tenido estos delitos, los cuales son cometidos por personas de diferentes estratos sociales. En pocas palabras; esta es una obra que todos debemos leer para estar claros sobre los distintos delitos que existen y también, estar prevenidos a estas personas que no tienen ningún tipo de consideración con las víctimas. Entre ellos; se identifican el engaño, error, disposición patrimonial perjudicial y ánimo de lucro. Estos términos también los pude aclarar con mi hermano, quien me indicó de primera mano el significado de cada uno de ellos; él también concuerda con el autor al expresar, que no solo es preciso conocer estos conceptos; sino que hay que entender que la aplicación de cada uno de ellos puede cambiar el aspecto del delito. Por consiguiente; sabemos que en el campo judicial, la omisión o descripción fallida de un término, puede ser causal de ciertas confusiones; en tal sentido, el objetivo de este texto es el de estar claros en lo que son las estafas y las apropiaciones indebidas. A continuación, indico un poco sobre ambos términos y esto no quiere decir que estoy emitiendo spoiler; sino, que siempre es bueno tener un conocimiento preciso sobre los temas tratados. En este caso; el autor nos dice que la estafa está basada en un engaño que ocurre al inicio, con el objeto de recibir un bien. Ahora; en lo que respecta a la apropiación indebida, esta inicia con la tenencia legítima de un bien; sin embargo, esta tenencia se convierte en ilegal. Esto último parece ser un enredo; sin embargo, de acuerdo a los ejemplos descritos en el libro; de forma particular les puedo crear un ejemplo propio y esto es algo en lo que cualquiera de nosotros podemos incurrir; por ello, debemos tener conocimiento al respecto, porque también hay varios tipos de apropiación indebida. Por ejemplo; yo recibo un dinero con el compromiso de devolverlo en x tiempo y cuando se cumple el plazo no lo devuelvo; además, hago con ese dinero lo que quiero; allí estoy incurriendo en el delito antes señalado, si has hecho esto; cuídate porque sabes lo que te espera.    Lo que me llama la atención de este libro; es que aunque el tema podría ser complejo para quienes no están inmersos en este mundo; el autor es sumamente didáctico, metódico y utiliza un lenguaje técnico que resulta de fácil comprensión. Si conoces del tema, eres estudiante, o simplemente tienes la curiosidad de aprender cosas nuevas; estoy seguro que lo vas a entender. Además; el texto está muy bien estructurado, lo que facilita la localización de los puntos de interés; por ejemplo, el autor también explica que no basta con incumplir un contrato; sino, que es de suma importancia demostrar que ha existido mala fé y ánimos de cometer el fraude desde que se ha comenzado la actuación. Una cosa que debemos entender; es que hay diversas modalidades de estafa y de apropiación indebida. Otro punto que destaca el autor; es que la criminalidad ha avanzado de tal forma, que es imperativa la actualización de nuestras leyes venezolanas; se dice esto, porque un aspecto a destacar son los delitos de índole tecnológico y esto me sorprende; ya que el libro tiene un tiempo en el mercado y el autor ya estaba mirando hacia el futuro del mundo delictivo. En fin; este es un texto sumamente interesante para aquellos que están inmersos e interesados en el derecho penal. Una obra muy explícita; donde puedes encontrar teorías, prácticas y mucho análisis lógico; lo que garantiza un aprendizaje detallado y preciso sobre los temas tratados.
